Depending on the European country, there are national regulations such as e.g., the German Food Supplements Regulation (NemV) and the German Food Information Regulation (LMIV) in Germany.

When advertising food/nutritional supplements, regulations such as the general prohibition of misleading information in Article 7 (1) of the Food Information Regulation (LMIV) or the prohibition of disease-related advertising in Article 7 (3) of the LMIV must be observed.

If food supplements are advertised with nutrition and/or health claims, the regulations of Regulation (EC) No. 1924/2006 (Health Claims Regulation (HCVO)) apply. According to Article 8 HCVO, nutrition claims may only be made if they are listed in the Annex to the Regulation and also comply with the conditions laid down therein. Health claims are only allowed according to Article 10(1) HCVO if they are included in the positive list according to Regulation (EU) No. 432/2012/EFSA (European Food Safety Authority).
